Terms of Service

These Terms govern the Optic website, app, AI features, reports, subscriptions, free trials, support, and related services.

1. Agreement

By visiting the website, creating an account, downloading the app, starting a trial, subscribing, importing data, or clicking to accept these Terms, you agree to them. "Optic," "we," "us," and "our" mean the operator of Optic. "Services" means the website, app, AI systems, inference tools, reports, subscriptions, support, and related services.

2. Eligibility

Optic is designed for adults. You must be at least 18 years old and able to form a binding contract to use the Services. Optic is not directed to minors, and users under 18 may not create accounts or use the Services.

3. Accounts

Provide accurate account information and keep it current. You are responsible for activity under your account and for protecting credentials. Notify us promptly at hello@tryoptic.app if you suspect unauthorized access.

4. Website And App

Website content is provided for general information and product access. App features may include local analysis, imports, reports, device-level settings, and notifications if enabled. App-store terms and platform rules may also apply to downloads, in-app purchases, refunds, and subscriptions.

5. Business Features

Optic may later offer business, team, or professional features. Those features may be governed by additional terms, order forms, or data-processing terms. Additional terms control for the relevant business feature if they conflict with these Terms.

6. License

Subject to these Terms, Optic grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your personal or internal professional purposes.

7. Acceptable Use

You may not:

  • violate law or third-party rights;
  • submit data you lack authority to provide;
  • use Optic for unlawful surveillance, harassment, or doxxing;
  • use Optic to make eligibility decisions about credit, housing, employment, insurance, education, or public benefits;
  • use Optic as legal, medical, financial, security, therapeutic, or other professional advice;
  • upload malware or interfere with service integrity;
  • scrape, reverse engineer, or bypass technical restrictions;
  • extract material parts of the Services to build a competing service, except where law prohibits this restriction;
  • process regulated sensitive data unless Optic expressly supports that workflow in writing.

8. Sensitive Data Restrictions

Optic is not designed to process health, biometric, financial, precise geolocation, school-record, child, or similarly regulated sensitive data. Do not submit those data types unless a feature expressly requests them and Optic provides product-specific terms.

Optic is not a HIPAA-covered service, business associate, educational record system, marketplace, credit-reporting agency, employment-screening service, housing-screening service, or legal-services provider.

9. User Content

"User Content" means data, files, prompts, instructions, text, documents, images, links, settings, imports, and other materials you submit or authorize Optic to process. You retain ownership of User Content.

You grant Optic a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transform, transmit, and display User Content as needed to provide, secure, support, maintain, improve, and operate the Services, comply with law, and enforce these Terms.

10. AI Outputs And Inferences

Optic may generate reports, summaries, labels, classifications, predictions, recommendations, confidence levels, automations, and other outputs. Outputs are probabilistic and may be wrong, incomplete, outdated, biased, or misinterpreted.

Outputs are for private informational use only. They are not professional advice and are not eligibility, credit, employment, housing, insurance, education, legal, medical, financial, or public-benefit determinations. You are responsible for reviewing outputs before relying on them.

As between you and Optic, you retain rights in User Content. To the extent Optic has rights in outputs generated for your account, Optic assigns those rights to you, subject to these Terms and law.

11. Training And Improvement

For consumer Services, Optic may use interactions, feedback, diagnostics, outputs, and User Content to evaluate, secure, improve, and develop the Services, including AI models and inference systems. Optic will provide controls where required by law or product design.

Optic does not sell User Content. Optic does not use targeted advertising or cross-context behavioral advertising for the MVP. Business features may apply different training commitments in later terms.

12. Subscriptions, Trials, And Billing

Optic may offer free trials, paid subscriptions, in-app purchases, or other paid features. Prices, billing frequency, renewal terms, trial terms, and cancellation methods will be presented before purchase.

If a plan renews automatically, you authorize recurring charges until you cancel. Trial plans may convert to paid subscriptions if disclosed before you start the trial. You can cancel through the account, billing provider, app store, or other cancellation method presented at purchase.

Fees are non-refundable except where required by law, required by app-store rules, or stated in the purchase flow. Taxes may apply. If payment fails, Optic may suspend or downgrade paid features after reasonable notice where feasible.

13. Communications

Optic may send service, security, billing, legal, and account messages. Optic may send marketing messages where permitted by law. You can opt out of marketing emails, but not essential service or legal notices.

14. Third-Party Services

The Services may integrate with app stores, payment processors, analytics providers, support providers, AI providers, data sources, or other third parties. Third-party services are governed by their own terms and policies.

15. Suspension And Termination

Optic may suspend or terminate access if you breach these Terms, create legal or security risk, misuse the Services, fail to pay, or if Optic must comply with law. Where reasonable, Optic will provide notice and an opportunity to cure.

16. Disclaimers

THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND ERROR-FREE OPERATION.

17. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, GOODWILL, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIC'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID TO OPTIC IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD 100.

18. Governing Law

These Terms are governed by Delaware law, excluding conflict rules. The state and federal courts located in Delaware have exclusive jurisdiction over disputes relating to these Terms or the Services, except that either party may seek injunctive relief in any court of competent jurisdiction.
